The Court hears Counsels' opposing representations concerning the production of a series of Plaintiff's computers which are currently in a storage facility. After hearing Counsels' positions, IT IS ORDERED: Within 14 days of today's date, Plaintiff will disclose the location of the computers in question and make them available for Defendant's computer forensic expert to examine them. Plaintiff has the option to pre-examine them for priviliged information, but it would be at his own expense and obligation to complete the review and to request that privilged information be withheld. Plaintiff's Counsel is advised that the Plaintiff will be sanctioned in the amount of $500.00 per day each and every day beyond the 14 days permitted by the Court that these materials are not made available for inspection. Additionally, Mr. Mangano's Motion to Withdraw as Counsel 116 will not be granted until these arrangements are made. Counsel further Stipulate on the record that Defendants can review the information in it's entirety and will not take the position that any privilege was waived by Plaintiff making the content of the computer systems available. The Court advises Counsel to submit that Stipulation in a proposed form of Order for the Court to review and sign. Defense Counsel requests that the computers be made available to ship to San Francisco where their forensics expert is located. Plaintiff's Counsel states their opposition to this request. IT IS ORDERED: The Court will not require the computers be shipped to San Francisco, and Defense Counsel can either transmit mirror images of the hard drives to their expert or they are advised to locate a local forensic expert.
